Judges Skeptical of Ryder Ripps’ Attempt to Dismiss Bored Ape Yacht Club Lawsuit

Legal Battle Over NFTsThe legal battle surrounding nonfungible token (NFT) artist Ryder Ripps and his involvement in creating derivative Bored Ape NFTs has encountered skepticism from a panel of judges. Ripps and Jeremy Cahen, known as “Pauly” on X, are facing a lawsuit related to their Bored Ape derivative project.

Anti-SLAPP Argument

Ripps and Cahen’s attorney, Thomas Sprankling, argued that the case should be dismissed under California’s anti-SLAPP statute, which aims to prevent intimidatory lawsuits. He claimed that Ripps and Cahen’s project was an artistic protest that pushed the boundaries of free speech. However, the judges seemed unconvinced.

Focus on Secondary Sales

The judges appeared to focus on the secondary sales of the NFTs and expressed doubts about the argument that artistic criticism should be considered.

Yuga Labs’ Complaint

Yuga Labs filed a complaint against Ripps and Cahen in 2022, alleging trademark infringement, false advertising, and unfair competition related to their RR/BAYC NFT collection.

Upcoming Ruling

The judges’ skepticism comes after a California District Court found that Ripps and Cahen had infringed Yuga Lab’s trademarks with their NFT collection. However, the court is yet to announce the conclusion of the case, including any potential damages to be paid.
